SUSPENDING AN ENVIRONMENTAL AUTHORISATION
Who May Suspend An Environmental Authorisation?
The relevant Competent Authority may decide to suspend an Environmental Authorisation.
When May The Competent Authority Suspend An Environmental Authorisation?
If withdrawal of the Environmental Authorisation is being considered, the Environmental Authorisation may be suspended pending the decision, if;
- there are reasonable grounds for believing that contravention or non-compliance with a condition of the Environmental Authorisation causes harm to the environment; and
- suspension of the Environmental Authorisation is necessary to prevent harm or further harm to the environment.
Process For Suspension Of An Environmental Authorisation:
The Competent Authority may, by written notice to the holder, suspend the Authorisation with immediate effect.
Continuing with a Suspended activity may lead to criminal penalties.
